1. Introduction & Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the website Pehchano.in ("Platform"), including all related services, features, WhatsApp integration, and APIs, owned and operated by Ellvero Technologies Pvt. Ltd. ("Company", "we", "us", or "our"), a company incorporated under the Companies Act, 2013, in India.

By accessing or using the Platform in any manner, you ("User", "you", or "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. About the Platform

Pehchano.in is an online scam detection and advisory platform that allows users to check URLs, UPI IDs, challan numbers, and bank account details against known scam databases and heuristic detection algorithms. The Platform provides risk assessments and advisory information to help users make informed decisions.

3. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials (email, password, and any linked WhatsApp number).
• You agree to provide accurate, current, and complete information during registration.
• You are solely responsible for all activities that occur under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Platform.

5. Services & Limitations

5.1 Advisory Nature

The results provided by Pehchano.in are advisory in nature only. They do not constitute legal advice, financial advice, or any form of guarantee. We make reasonable efforts to provide accurate detection, but:

• A "safe" result does not guarantee that a link, UPI ID, or entity is free from fraud.
• A "scam" or "suspicious" result does not constitute a definitive legal determination.
• Users should always exercise independent judgment and due diligence.

5.2 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted, error-free, or secure access to the Platform at all times. We may temporarily suspend services for maintenance, updates, or reasons beyond our control.

5.3 Rate Limits

Free and paid plans have different usage limits (checks per day). Exceeding these limits may result in temporary access restrictions until the next reset period. Specific plan limits are detailed on our Pricing page.

6. Subscription Plans & Payments

6.1 Plans

Pehchano.in offers free and paid subscription plans. Paid plans unlock additional features such as unlimited checks, challan verification, bank detail checks, and API access. Plan details and pricing are available on the Pricing page.

6.2 Payment

All payments are processed in Indian Rupees (INR) through third-party payment gateways. By making a payment, you agree to the payment processor's terms and conditions. Prices are inclusive of applicable taxes unless stated otherwise.

6.4 Subscription Period

Subscriptions are valid for the billing period selected at the time of purchase (monthly or yearly). Access to paid features will be available until the subscription expires. There is no automatic renewal unless explicitly stated.

7. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to reverse-engineer, decompile, or hack any part of the Platform
• Use automated bots, scrapers, or tools to make bulk requests beyond your plan's rate limits
• Submit false reports or intentionally misleading data
• Use the Platform to harass, defame, or infringe on the rights of others
• Resell, redistribute, or sublicense access to the Platform without our consent
• Impersonate another person or entity
• Circumvent or disable any security features of the Platform

Violation of these terms may result in immediate suspension or termination of your account without notice.

8. Intellectual Property

All content, software, algorithms, designs, trademarks, logos, and other intellectual property displayed on or used in connection with the Platform are the exclusive property of Ellvero Technologies Pvt. Ltd. or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

9. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be available at all times without interruption
• Results will be 100% accurate, complete, or error-free
• The Platform will detect every scam or fraudulent entity
• Use of the Platform will protect you from financial loss

10. Limitation of Liability

To the maximum extent permitted by applicable law, Ellvero Technologies Pvt. Ltd., its directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

• Your use of or inability to use the Platform
• Any reliance on information or results provided by the Platform
• Unauthorized access to your account or data
• Any financial loss resulting from scams not detected by the Platform
• Service interruptions, downtime, or data loss

In no event shall our aggregate liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Ellvero Technologies Pvt. Ltd. and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

12. WhatsApp Services

Our WhatsApp integration is subject to the following additional terms:

• All WhatsApp interactions are initiated by the user. We do not send outbound messages without user consent.
• By linking your WhatsApp number, you consent to receiving verification OTPs and check results that you explicitly request.
• We do not send marketing, promotional, or unsolicited messages via WhatsApp.
• WhatsApp services are provided through Meta's WhatsApp Business Platform and are subject to Meta's terms and policies.
• You may unlink your WhatsApp number at any time from your account settings.
• Standard data and messaging charges from your mobile carrier may apply.

13. Termination

We may terminate or suspend your access to the Platform at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Platform ceases immediately
• We may delete your account data, subject to any legal retention requirements
• No refund of any subscription fee will be provided

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page with an updated "Last updated" date. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.

Before initiating any legal proceedings, the parties agree to attempt resolution through good-faith negotiations for a period of at least 30 days.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ellvero Technologies Pvt. Ltd. regarding the use of the Platform and supersede all prior agreements and understandings.
